Government Regulations for Victorian Rental Properties

As of March 2021, the introduction of crucial new government regulations has made it mandatory for all rental properties in Victoria to undergo electrical safety checks and services conducted by a licensed electrician every two years. Furthermore, the law stipulates that all smoke alarms must be tested according to the manufacturer's instructions and replaced, if necessary, at least once every 12 months.

Our Safety Check Services Include:

  • A comprehensive electrical safety assessment of the installation, switchboard, and fittings provided by the landlord.

  • Testing all smoke alarms in the property, excluding apartments (which must be tested by a specialist technician), to ensure they function correctly.

Upon Completion of Our Checks, You Will Receive:

A dated digital report prepared by Section 2 of AS/NZS 3019 “Electrical Installations – Periodic Verification.” This report will include:

  • The name of the licensed electrician who performed the inspection.

  • The license number of the electrician.

  • The date of the inspection.

  • Results of the inspection, including any necessary repairs and actions taken to address these issues.

The report will also contain details about all smoke alarms in the residence, including:

  • The date of the test.

  • The type of smoke alarms (battery-operated or hardwired).

  • Instructions on how to test each smoke alarm in the premises.

  • A warning to tenants against tampering with smoke alarms and advising them to report any non-functional alarms.

It's crucial to note that records of every residence’s electrical safety checks and smoke alarm tests must be maintained until new checks are conducted and updated reports are issued. This responsibility ensures the safety and well-being of your tenants.

What is the landlord responsible for?

Landlords are obligated to adhere to several key responsibilities to ensure the safety of electrical systems within their rental properties:

  • Use of Licensed Professionals: All electrical work must be performed exclusively by licensed electrical professionals to guarantee compliance with safety standards and regulations.

  • Providing Safety Reports: Landlords must provide tenants with a copy of the most recent electrical safety check report within 7 days of receiving a written request. This ensures transparency and awareness of the property's safety status.

  • Conducting Timely Checks: If an electrical safety check has not been completed within the last 2 years when a tenant moves into the premises, landlords are required to arrange for a safety check as soon as possible to ensure the property is safe for occupancy.

  • Smoke Alarm Maintenance: Upon receiving notification from a tenant that a smoke alarm is no longer functioning, landlords must organise an urgent replacement to maintain safety compliance and protect the tenant’s well-being.

  • Inspection of Electrical Appliances: Landlords should ensure that all provided electrical appliances are safe before a new tenant moves in. This includes inspecting plugs, leads, and casings for any damage that could expose live parts or pose a fire hazard. TNG Electrical can conduct this assessment for an additional fee to ensure all appliances meet safety standards.

What is the tenant responsible for?

Tenants also have specific responsibilities to ensure the electrical safety of their rental properties. These include:

  • Non-Interference with Safety Devices: Tenants must ensure that they do not remove, deactivate, or interfere with the operation of any prescribed safety devices, such as smoke alarms and Residual Current Devices (RCDs).

  • Reporting Faulty Appliances: Tenants must immediately report any clearly faulty appliance to the landlord in writing. Prompt reporting helps ensure that necessary repairs are made quickly to maintain safety.

  • Notification of Smoke Alarm Issues: If tenants become aware of a smoke alarm issue, they must provide the landlord with written notice to facilitate timely maintenance or replacement.

  • Allowing Access for Safety Checks: Tenants must provide the landlord's contractor reasonable access to conduct required electrical safety checks and maintenance. This cooperation is essential for ensuring the property remains safe and compliant with regulations.
